Amethi Lok Sabha Seat: A walkover for BJP?

 

The announcements of Congress candidates for Amethi and Rae Bareli at the eleventh hour have not gone well in the UP Congress circles. The dejected party workers are reportedly upset by fielding a loyalist of Gandhi family from Amethi. Even experts have opined that by fielding an unknown face, the Congress has given a walkover for BJP in Amethi Parliamentary constituency.

 

 

Rahul will face an ex- Sonia loyalist from Rae Bareli

BJP has fielded Dinesh Pratap Singh, a former close lieutenant of Sonia Gandhi. He joined the BJP in 2019 and presently is a minister and MLC in the UP Government. Rahul Gandhi will face a tough challenge from local chap Singh.

High Courts facing shortage of 327 judges

While several lakhs cases are pending in various High Courts across the country, a significant 327 posts out of total sanctioned strength of 1,114 judges in High Courts across the country have been lying vacant. Significantly, five key High Courts — Allahabad, Punjab and Haryana, Gujarat, Bombay, and Calcutta — are bearing the brunt of this shortfall, accounting for over 52 per cent of the total vacancies. These vacancies contribute to a backlog of cases, with the total number of pending cases in High Courts reaching nearly 62 lakh as of April 30. The issue extends beyond High Courts, with over 5.1 crore cases pending across all courts nationwide. The Allahabad High Court, for instance, faces a vacancy rate of 43 per cent, with 69 posts  — out of total 160 — lying vacant. Likewise, the Gujarat High Court faces a 44 per cent shortfall. Similarly, High Courts of Patna and Rajasthan have a high vacancy rate of 36 per cent.

Justice ( Retd) Sanjaya Kumar Mishra, former Chief High Court of Jharkhand, has been appointed as President in Goods and Services Tax Appellate Tribunal (GSTAT) for a period of four years.

Subodh Kumar appointed as Director, Ayush

Subodh Kumar has been appointed as Director in the Ministry of Ayush. He is a 2010 batch IAS officer of Tamil Nadu cadre.

Ramya Bharati appointed DDG, BCAS

Mrs R V Ramya Bharati has been appointed as Deputy Director General in Bureau of Civil Aviation Security (BCAS) for a maximum of 5 years. She is a 2008 batch IPS officer of Tamil Nadu cadre.

NSE’s consolidated Q4 operating revenue up by 34% YoY at Rs.4,625 cr (UPDATED)

NSE, India’s leading exchange, reported consolidated revenue from operations at Rs.4,625 crores for Q4 FY24, up by 34% on a year-on-year basis. Apart from trading revenue, the revenue from operations was also supported by other revenue lines which mainly includes data centre & connectivity charges, clearing services, listing services, index services and data services. NSE posted net profit of Rs.2,488 crores on a consolidated basis for Q4 FY24, up by 20% on a year-on-year basis. The net profit margins for Q4 FY24 stood at 49%. On a consolidated basis, earnings per share increased to Rs.50.25 in Q4 FY24 from Rs.41.72 in Q4 FY23. On the trading volumes front, cash markets recorded an average daily traded volumes (ADTVs) of Rs.1,11,687 crores (up 127% YoY) while the equity futures reached an ADTV of Rs.1,79,840 crores (up 60% YoY) and equity options (premium value) ADTVs stood at Rs.75,572 crores (up 27% YoY) for Q4 FY24. NSE on a standalone basis reported total operating income of Rs.4,123 crores for Q4 FY24, showing a growth of 25% on a year-on-year basis which was Rs.3,295 crores for the corresponding quarter last year. NSE during the quarter on a standalone basis incurred total expenses of Rs.1,926 crores for Q4 FY24. Almost 46% of these expenses amounting to Rs.882 crores, are towards SEBI Regulatory Fees, additional contribution to Core SGF as desired by SEBI and Contribution to IPFT. NSE in the FY24 has made additional contribution of Rs.1,741 crores and NCL has made additional contribution of Rs.1,400 crores to augment the Core Settlement Guarantee Fund corpus from current level to Rs.10,000 crores as desired by SEBI. The corpus of core SGF as at March 31, 2024 is Rs.8,819 crores. At the operating EBITDA level NSE, on a standalone basis, posted an EBITDA margin of 56% for Q4 FY24 compared to 69% in the corresponding quarter last year.  NSE reported standalone net profit of Rs.1,856 crores for Q4 FY24 which was Rs.1,810 crores for the corresponding quarter last year. The net standalone profit margin stood at 42%. NSE Board has recommended a dividend of Rs 90 per share (pre-bonus) for the year ending FY 24 amounting to pay-out of Rs.4,455 crores. NSE Board has also recommended issue of 4 bonus shares for existing 1 share held, subject to necessary approvals from shareholders and regulators for increase in authorised share capital. NSE Contributed Rs.43,514 crores to the exchequer for FY24 of which STT/CTT comprised of Rs.34,381 crores, Income tax of Rs.3,275 crores, Stamp duty of Rs.2,833 crores, GST of Rs.1,868 crores and SEBI charges of Rs.1,157 crores. Out of the STT of Rs.34,381 crores 60% is from cash market segment and 40% is from equity derivatives segment. The STT collection of Rs.34,381 crores are 24.46% higher than the annual Budget Estimate of Rs.27,625 crores. This STT accounts for 3.77% of the net personal Income Tax collections for the financial year 2023-24.

Will Rahul leave Wayanad or Rae Bareli

Rahul Gandhi has filed papers from both Wayanad and Rae Bareli. In case he wins at both seats he is more likely to retain Rae Bareli as it is a bastion of Gandhi family. This will not send a good message to voters in Wayanad. Nevertheless, Cong's decision to field Rahul from Rae Bareli means a by-election if Rahul emerges victorious at both places. The EC must consider prohibiting candidates from contesting from more than one seat as it leads to by-poll.

DATE WITH RTI

Is Justice Lodha Committee constituted by the Supreme Court a Public Authority?

The Appellant filed an RTI application with PACL Nodal Officer and Secretary, Judge (Retd) R.M. Lodha Committee seeking certain information. Having not received any response from the CPIO, the Appellant filed a First Appeal with the FAA, PACL Nodal Officer and Secretary, Judge (Retd) R.M. Lodha Committee. Aggrieved with the non-receipt of any response, the Appellant approached the CIC. During hearing, the attention of the CIC was invited towards the following clarification mentioned in the written submissions filed by SEBI, copy of which was also endorsed to the Appellant. The clarification read, “…the Justice Lodha Committee having been constituted by an order dated 02/02/2016 of the Hon'ble Supreme Court of India is not a Public Authority within the meaning under Section 2 (h) of the RTI Act, 2005 and hence would not fall within the purview of the said Act…” After adverting to the facts and circumstances of the case, and perusal of records, the CIC observed that the Appellant has not filed the RTI Application with any public authority as required under Section 6(1) of the RTI Act.

Comments

The CIC has preferred to rely on the submissions of the respondent without referring to the definition of a public authority as per section 2(h) of the RTI Act. any authority or body or institution of self-Government established or constituted by notification issued or order made by the appropriate Govern­ment is covered under the definition of a public authority. As per section 2(a) of the RTI Act, "appropriate Government" means in relation to a public authority which is established, constituted, owned, controlled or substantially financed by funds provided directly or indirectly by the Central Government or the Union territory administration, the Central Government. It is apparent that Justice Lodha Committee having been constituted by an order dated 02/02/2016 of the Hon'ble Supreme Court of India is a Public Authority within the meaning under Section 2 (h) of the RTI Act, 2005.
